Affiliate Program Terms & Conditions

1. Program Overview

The Your Story Voice Affiliate Program ("Program") allows approved content creators ("Affiliate") to earn commissions by referring new paying subscribers to Your Story Voice ("Company"). By submitting an application and signing electronically, you agree to be bound by these Terms and Conditions ("Agreement").

2. Eligibility

To participate you must: (a) be at least 18 years of age; (b) maintain an active public content channel, profile, or blog; (c) receive written approval from the Company; and (d) comply with all applicable laws and regulations including FTC disclosure guidelines.

3. Commission Structure

• Affiliates earn 50% of the one-time purchase price for each referred customer.
• Commissions are earned at the time the referred customer completes their one-time purchase.
• One-time purchase rates: First Stories — $49 (Affiliate earns $24.50); Family Library — $99 (Affiliate earns $49.50); Grandparent Gift — $129 (Affiliate earns $64.50).
• Commissions are paid once per referred customer purchase. There are no recurring monthly commissions as all plans are one-time purchases.
• Commission rates may be updated by the Company with 30 days' written notice.

4. Tracking & Attribution

Each Affiliate receives a unique referral code and link. A referral is credited when a new subscriber signs up using the Affiliate's unique link and completes their first payment. The Company's tracking system is the sole source of truth for attribution. Cookie-based tracking lasts 30 days.

5. Payment Terms

• Commissions are calculated monthly and paid within 15 business days of month-end.
• Minimum payout threshold is $25.00 USD. Balances below the threshold carry over to the next month.
• Payments are made via PayPal or Venmo to the payout email provided on the application.
• Affiliates are solely responsible for all applicable taxes on commissions received.

6. Prohibited Conduct

Affiliates may not:

• Engage in paid search bidding on the Company's brand keywords.
• Use spam, unsolicited email, or deceptive marketing practices.
• Self-refer or refer their own family members' accounts to earn commissions.
• Misrepresent the Company's products, pricing, or features in any content.
• Use any content that is discriminatory, offensive, or violates applicable laws.

7. FTC Disclosure Requirement

All promotional content must include a clear and conspicuous disclosure that the Affiliate has a material connection to the Company and may earn a commission. Example: "I may earn a commission if you sign up using my link." Failure to disclose may result in immediate termination.

8. Intellectual Property

The Company grants Affiliates a limited, non-exclusive, revocable license to use approved Company logos, trademarks, and creative assets solely for the purpose of promoting Your Story Voice under this Agreement. Affiliates may not modify official brand assets.

9. Term & Termination

This Agreement begins upon approval and continues until terminated. Either party may terminate with 14 days' written notice. The Company may terminate immediately for breach of these Terms. Upon termination, earned commissions for completed billing periods will be paid; unearned future commissions are forfeited.

10. Confidentiality

Affiliates agree to keep confidential any non-public information shared by the Company, including commission rates, internal data, and business strategies.

11. Limitation of Liability

THE COMPANY'S TOTAL LIABILITY TO AFFILIATE UNDER THIS AGREEMENT SHALL NOT EXCEED THE TOTAL COMMISSIONS PAID TO AFFILIATE IN THE THREE MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

12. Modifications

The Company reserves the right to modify these Terms at any time. Continued participation after notice of changes constitutes acceptance of the updated Terms.

13. Governing Law

This Agreement is governed by the laws of the State of Texas, USA, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the AAA rules.

UGC 1. Purpose

The purpose of this User Generated Content Agreement is to seek your permission to use and showcase your social media content generated by you on our website, social media sites, and promotional/informational materials. By submitting your affiliate application and signing electronically, you agree and accept the terms of this UGC Agreement, entered by and between you, the owner of the social media content, and Your Story Voice ("Company").

UGC 2. Ownership Warranty

You warrant that you own all rights in and to your social media content ("UGC"), and have the exclusive right to license to others the right to produce, copy, make, sublicense, or sell the UGC.

UGC 3. License Grant

You hereby grant to Your Story Voice and its related companies, agents, licensees, sublicensees, contractors, successors, assignees, third-party service providers, and other affiliates (collectively "Licensees") in accordance with the terms and conditions of this Agreement, a worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, and transferrable license to use, display, reproduce, distribute, transmit, create derivative works from, and alter, your UGC for any purpose, in any manner, including general advertising materials and point of sale displays, and other promotional/informational materials, and in any form of media.

UGC 4. Non-Exclusivity

Your Story Voice acknowledges and agrees that the license granted herein is non-exclusive and that you may license others to use the UGC.

UGC 5. Ownership Rights Reserved

Your Story Voice acknowledges that you are the sole and exclusive owner of the UGC, and Your Story Voice shall do nothing inconsistent with such ownership. Your Story Voice further agrees that it will not claim ownership rights to the UGC, or any derivative, compilation, sequel or series, or related content owned by or used by you. Your Story Voice agrees that nothing in this Agreement shall give Your Story Voice any right, title, or interest in the UGC other than the right to use the same in accordance with the terms of this Agreement.

UGC 6. Release of Liability

You release, discharge, and agree to hold Licensees, and any person acting on their behalf, harmless from any liability related in any way to Licensees' use of your UGC.

UGC 7. Intellectual Property of Your Story Voice

Websites or social media sites owned or operated by Your Story Voice may be protected by copyright, trademark, and other intellectual property laws. You acknowledge and agree that you do not acquire any ownership or other rights in proprietary information and materials of Your Story Voice by authorizing use of your UGC or otherwise using or accessing websites or social media sites owned or operated by Your Story Voice.

UGC 8. Dispute Resolution & Governing Law

All disputes arising from the terms of this UGC Agreement may be subjected to binding arbitration upon consent of both parties, with one arbitrator selected by each party, and a third arbitrator selected by the two chosen arbitrators. This Agreement shall be governed by and construed in accordance with the laws of Texas without regard to the conflicts of laws rules thereof, and any arbitration shall be brought in Texas using Texas state laws when applicable.
